Please read these Terms of Use carefully before accessing or using any part of this platform. By creating an account, enrolling in a workshop, or otherwise using our services, you agree to be bound by these terms. If you do not agree, do not use the platform.
1. Definitions
Throughout these Terms, the following definitions apply:
- Platform refers to the website, web application, and all associated services operated by Nolapesku.
- User refers to any individual who accesses or uses the Platform, whether registered or not.
- Account refers to a registered user profile created to access features of the Platform.
- Content refers to all text, video, audio, exercises, assignments, code samples, and other materials available on the Platform.
- Submissions refers to any work, responses, code, comments, or other materials a User uploads or contributes to the Platform.
2. Eligibility
You must be at least 16 years of age to use the Platform independently. Users between the ages of 16 and 18 represent that they have the consent of a parent or legal guardian where required by applicable law. By using the Platform, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and current.
3. Account Registration and Security
3.1 Account Creation
To access certain features, you must register for an Account. You agree to provide accurate, complete, and up-to-date information during registration and to update that information as needed to keep it accurate.
3.2 Credentials
You are responsible for maintaining the confidentiality of your login credentials. You must not share your Account with any other person. You are solely responsible for all activity that occurs under your Account.
3.3 Unauthorized Access
If you believe your Account has been accessed without your authorization, you must notify us immediately at [email protected]. We are not liable for any loss arising from unauthorized use of your Account where you have failed to take reasonable precautions.
4. Permitted Use
You may use the Platform solely for lawful personal educational purposes in accordance with these Terms. You agree not to:
- Use the Platform for any commercial purpose without prior written consent.
- Copy, reproduce, distribute, or publicly display any Content without authorization.
- Attempt to reverse engineer, decompile, or extract source code from any part of the Platform.
- Upload or transmit malicious code, viruses, or any software designed to disrupt the Platform.
- Scrape, harvest, or systematically collect data from the Platform by automated means.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the integrity or performance of the Platform or its infrastructure.
- Attempt to gain unauthorized access to any portion of the Platform or its related systems.
5. Intellectual Property
5.1 Platform Content
All Content on the Platform, including but not limited to course materials, instructional videos, written exercises, design assets, and software, is owned by or licensed to Nolapesku and is protected by applicable intellectual property laws. No Content may be reproduced, modified, or redistributed without express written permission.
5.2 User Submissions
By submitting any material to the Platform, you grant Nolapesku a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce that material for the purpose of operating and improving the Platform. You retain ownership of your Submissions and represent that you have the right to grant this licence.
5.3 Feedback
If you provide suggestions, feedback, or ideas regarding the Platform, you grant Nolapesku the right to use such feedback freely without any obligation of compensation or attribution.
6. Enrolment and Access
6.1 Workshop Access
Upon successful enrolment in a workshop or programme, you are granted a limited, non-transferable, non-exclusive right to access the associated Content for the duration specified at the time of enrolment.
6.2 Access Conditions
Access to Content may be subject to completion of prerequisite steps, payment of applicable fees, and compliance with these Terms. Nolapesku reserves the right to modify, suspend, or discontinue any workshop or programme at any time with reasonable notice where practicable.
6.3 No Transfer
Enrolment and access rights are personal to you and may not be transferred, sold, or shared with any third party.
7. Payments and Refunds
7.1 Fees
Certain features and workshops require payment. All fees are stated at the time of purchase. By completing a purchase, you authorize us to charge the applicable fees to your chosen payment method.
7.2 Taxes
You are responsible for any applicable taxes, duties, or levies arising from your purchase, except where Nolapesku is required by law to collect and remit such amounts directly.
7.3 Refunds
Refund eligibility is determined by the refund policy presented at the time of enrolment. Where no specific refund terms are stated, refund requests may be submitted within 14 days of purchase if the course Content has not been substantially accessed. Refunds are not available after this period or after significant Content consumption.
7.4 Disputed Charges
If you believe a charge was made in error, contact us at [email protected] within 30 days of the charge. We will investigate and respond in a timely manner.
8. Community Standards and Conduct
The Platform includes collaborative tools, discussion areas, and peer interaction features. When participating, you agree to:
- Communicate respectfully and professionally with other participants and instructors.
- Refrain from posting content that is offensive, discriminatory, harassing, or harmful.
- Not share or reproduce other participants' Submissions without their explicit consent.
- Engage with exercises and assignments in good faith and submit your own original work.
- Not engage in academic dishonesty, including submitting work that is not your own as if it were.
Nolapesku reserves the right to remove any Submission and suspend or terminate any Account that violates these standards, without prior notice.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in that policy. We encourage you to review the Privacy Policy before registering.
10. Third-Party Links and Services
The Platform may contain links to third-party websites or integrate third-party tools and services. These are provided for convenience only. Nolapesku does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.
11. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Nolapesku does not warrant that:
- The Platform will be uninterrupted, error-free, or free of harmful components.
- Any Content is accurate, complete, or current.
- Results obtained through use of the Platform will meet your expectations or requirements.
To the fullest extent permitted by law, Nolapesku disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Nolapesku and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages. In no event shall Nolapesku's total aggregate liability exceed the amount paid by you to Nolapesku in the twelve months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Nolapesku and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your Submissions, your violation of these Terms, or your violation of any rights of a third party.
14. Modifications to the Terms
Nolapesku reserves the right to update or modify these Terms at any time. When changes are made, the updated Terms will be posted on the Platform with a revised "Last updated" date. If changes are material, we will make reasonable efforts to notify registered users. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform.
15. Modifications to the Platform
Nolapesku reserves the right to modify, suspend, or discontinue any feature, programme, or aspect of the Platform at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.
16. Termination
16.1 By You
You may terminate your Account at any time by contacting us at [email protected]. Termination does not entitle you to a refund except as expressly provided in our refund policy.
16.2 By Nolapesku
We may suspend or terminate your access to the Platform at our discretion, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason we consider sufficient. Upon termination, your right to access the Platform ceases immediately.
16.3 Survival
Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution shall survive any termination of these Terms or your Account.
17. Governing Terms and Dispute Resolution
These Terms are governed by general principles of commercial law applicable to online services, without reference to any specific jurisdiction's conflict of law rules. In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached informally within 30 days, disputes may be submitted to binding arbitration conducted in English under internationally recognized arbitration rules, unless prohibited by applicable law.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented at the point of enrolment, constitute the entire agreement between you and Nolapesku with respect to your use of the Platform and supersede all prior agreements, representations, or understandings.
